Konekt LLC Waiver and Release of Liability

The below Waiver and Release of Liability are a binding contract between you and Konekt, LLC and its affiliates, corporate parent(s), and subsidiaries, including but not limited to Konekt Club, Konekt Workshops, and any other entity over which Konekt LLC has control over. Please note that additional, separate terms (Makerspace, Studio, Konekt Club, Konekt Workshops) may apply to our services and programs.

Waiver and Release of Liability:

I, the undersigned, understand and acknowledge that participation in activities at Konekt LLC, Konekt Club and Konekt Workshops involves inherent risks, including but not limited to the risk of injury, illness, or damage to personal property. By signing this Waiver and Release of Liability, I acknowledge and accept these risks and agree to the following terms and conditions:

1. Assumption of Risk: I voluntarily choose to participate, or allow my child to participate, in the activities offered by Konekt LLC and assume all risks associated with such participation.

2. Release and Waiver: I, on behalf of myself, my heirs, executors, administrators, assigns, and my child (if applicable), hereby release, discharge, and hold harmless Konekt LLC, its owners, employees, instructors, agents, and representatives from any and all claims, demands, actions, or causes of action arising out of or in connection with my or my child’s participation in any activities, including but not limited to any injury, illness, or damage to personal property, whether caused by the negligence of the Studio or otherwise, to the fullest extent permitted by law.

3. Medical Treatment: In the event of an emergency, I authorize Konekt LLC to seek medical treatment for myself or my child if deemed necessary. I understand that I am responsible for any medical expenses incurred as a result of such treatment and agree to indemnify and hold harmless Konekt LLC for any costs incurred therein.

4. Use of Materials and Equipment: I agree to use, and to ensure my child uses, all materials, tools, and equipment provided by the Studio in a safe and responsible manner. I will follow, and ensure my child follows, all instructions and guidelines provided by the Studio's staff.

5. Indemnification: I agree to indemnify and hold harmless the Studio, its owners, employees, instructors, agents, and representatives from any and all claims, liabilities, and expenses (including reasonable attorney's fees) arising out of my or my child’s participation in the activities, my or my child’s use of the Makerspace facilities or equipment, or my breach of this Waiver and Release of Liability.

6. Governing Law: This Waiver and Release of Liability shall be governed by and construed in accordance with the laws of the State of Florida, specifically applicable to Broward County, without regard to its conflict of laws principles. Any legal action or proceeding arising under this Waiver and Release of Liability will be brought exclusively in the courts located in Broward County, Florida.

7. Severability: If any provision of this Waiver and Release of Liability is found to be unenforceable or invalid, the remaining provisions shall remain in full force and effect.

8. Right to Refuse Service: Konekt LLC reserves the right to refuse service to any individual or group at its sole discretion. This includes, but is not limited to situations where an individual or group exhibits disruptive, inappropriate or unsafe behavior that may negatively impact the experience of other participants or the ability of Konekt LLC to provide its services effectively and safely.

I acknowledge that I have read and understood this Waiver and Release of Liability, and I agree to be bound by its terms.
